Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Sheltr website, mobile applications, and related products and services (including the Sheltr Energy Monitor hardware where applicable) offered by Vstreamhd Private Ltd. (“Vstreamhd”, “we”, “us”, or “our”) (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.

1. Eligibility

You must be legally able to enter a binding contract in your jurisdiction and meet any minimum age requirements. You are responsible for the accuracy of information you provide.

2. Accounts

You may need to create an account. You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly of unauthorized use via the contact details on our Contact page.

3. The Services

Sheltr provides tools for property discovery, rental and management workflows, communications between stakeholders, payments facilitation, and energy monitoring. Features may vary by region and release stage (including beta or “coming soon” offerings). We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.

4. Hardware (Sheltr Energy Monitor)

If you purchase physical products, additional conditions apply: installation must comply with applicable electrical and safety regulations; misuse voids warranties except as required by law. Risk of loss and title pass according to our Shipping & Delivery policy.

5. Fees, billing, and taxes

Certain features may be free or paid. Fees are displayed at checkout or in-app. Unless stated otherwise, prices are in Indian Rupees (INR) for India-based transactions and may exclude applicable taxes (such as GST), duties, or convenience fees, which you are responsible for paying.

Subscriptions, if offered, renew according to the plan you select until cancelled. You authorize us and our payment partners to charge your chosen payment method.

6. Payments and payment gateways

Payments are processed by third-party payment gateways and financial institutions. By completing a purchase, you agree to their terms and privacy policies in addition to ours. We are not responsible for delays or failures caused by banks, card networks, or payment processors.

You represent that you are authorized to use the payment method you provide. Chargebacks and payment disputes may result in suspension of Services pending resolution.

7. Refunds and cancellations

Refunds and cancellations are governed by our Refund Policy, which forms part of these Terms.

8. Acceptable use

You agree not to misuse the Services, including by: violating law; infringing intellectual property; uploading malware; attempting unauthorized access; scraping or reverse engineering except as permitted by law; harassing users; posting fraudulent listings; or circumventing payment or security controls.

9. User content

You retain ownership of content you submit. You grant us a worldwide, non-exclusive license to host, use, display, and process such content as needed to operate and improve the Services. You represent that you have the rights to grant this license and that your content complies with law.

10. Intellectual property

The Services, Sheltr branding, software, and documentation are owned by Vstreamhd or its licensors. Except for the limited right to use the Services under these Terms, no rights are granted. “Sheltr” and related marks are trademarks of Vstreamhd or its affiliates.

11. Third-party services

The Services may link to or integrate third-party services (maps, payments, identity checks, etc.). Your use of those services is subject to their terms. We are not responsible for third-party content or conduct.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that energy data or financial calculations are always accurate; they are provided for informational purposes and operational convenience.

13. Limitation of liability

To the maximum extent permitted by applicable law, Vstreamhd and its officers, directors, employees, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims arising from the Services shall not exceed the greater of (a) the amount you paid us for the Services in the six (6) months before the claim or (b) INR 5,000, except where liability cannot be limited by law (including death or personal injury caused by negligence, fraud, or other non-excludable rights).

14. Indemnity

You will defend and indemnify Vstreamhd against claims arising from your use of the Services, your content, or your violation of these Terms or law, subject to applicable law.

15. Suspension and termination

We may suspend or terminate access for breach of these Terms, risk to security, or legal requirements. You may stop using the Services at any time. Provisions that by nature should survive (e.g. liability limits, indemnity, governing law) will survive termination.

16. Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory consumer protections in your jurisdiction, courts at Rewari, Haryana, India shall have exclusive jurisdiction over disputes, unless we agree otherwise or applicable law requires otherwise.

17. Changes

We may update these Terms. We will post the new version on this page and update the “Last updated” date. Continued use after changes constitutes acceptance, except where additional consent is required by law.
